Widows of U.S. Citizens

The widows or widowers of U.S. citizens may file a Form I-360 petition for themselves at the U.S. Department of Homeland Security(DHS), Citizenship and Immigration Services (CIS), at U.S. Embassy Seoul. To be eligible for an Immigrant Visa (IV) as the widow/ widower of a U.S. citizen:

  • The marriage must have existed more than two years prior to death and the couple cannot have been separated at the time of death.

  • The petition must be filed within two years of the death of the U.S. citizen spouse.

  • The widow or widower may not remarry prior to admission to the U.S. as a permanent resident.

When CONS/IV receives the approved I-360 petition from the CIS, CONS/IV mails to the applicant a detailed list of the required documents (SEO3.5) needed to apply for the IV.

If the applicants informs us that all the documents are ready, a visa interview can be scheduled by internet.


IV Appointment Request Only By Internet


The IV application fee is $400.  more 

If the applicant is found eligible for an IV, the visa will be delivered to the applicant via  courier within several working days. The non-U.S. citizen minor children of a widow or widower are also eligible for an IV based on the same petition.
